Introduction and Definitions

1. These Terms and Conditions (the "Terms") constitute a legally binding agreement between The Notting Hill Club, owned and operated by Body Works West, located at 10 Lambton Place, London W11 2SH (hereinafter referred to as"we," "us," "our," or "the Club"), and any individual using our services (hereinafter referred to as "you,""your," or "Customer"). By completing our registration process and using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms.  

For the purposes of these Terms:  "Customer" means an individual using our services for personal use (not business purposes);  
"Class" means any individual or group session provided at our facilities;  
"Term" means a standard term of classes as defined in our schedule;  
"Premises" means The Notting Hill Club facilities and any associated locations;
“Plan” means a recurring monthly subscription that entitles the customer to attend a predetermined number of classes within each billing cycle;
“Credits & Bundles” means a flexible payment system where you can purchase either single class credits or multi-class bundles for use at the Notting Hill Club.

2. REGISTRATION  

2.1 Registration Requirements  
In order to do any classes at The Notting Hill Club, it is contingent upon the completion of our official registration process. All prospective customers that are over 18 years of age at the time of application must provide accurate and complete information during registration, and all those customers that are under 18 years of age, an account must be created in the Parent/Guardian’s name on behalf of the child. The Club reserves the right to verify any information provided and request additional documentation where necessary.  A health waiver and release must also be read and accepted before taking part in any classes.

2.2 Acceptance and Duration  
Upon submission of your registration, we will review all information provided, and once we accept your registration form a contract will be formed between you and us, and will be governed by these terms and conditions.  

3. BOOKING AND ATTENDANCE POLICIES

3.1 Class Booking System  
The Club operates a comprehensive booking system for all classes and facilities. Customers must book and pay for all classes in advance through our designated booking platforms. While we strive to accommodate all booking requests, class spaces are subject to availability and allocated on a first-come, first-served basis.  

3.2 Cancellation and Attendance Policies
You must provide a minimum of 24 hours' notice for any class cancellation. Cancellations made within 24 hours of the scheduled class time will result in forfeiture of the class credit or payment. We maintain this policy to ensure fair access to our facilities for all customers and to maintain the quality o four classes.  If you are booking for your child into a full term of classes, once you have completed the registration process and your child been enrolled in a class at a specific time and date, there is no need to book each class individually. This will be the class that your child will attend for the duration of the term and your child will be automatically booked into every class.

In the interest of safety and class quality, customers arriving more than 5minutes after the scheduled start time may be denied entry to the class, with no refund or credit provided.  

4. PAYMENT TERMS AND CONDITIONS  

4.1 Fee Structure  
All customership fees and class payments must be made in advance of service provision. Our fee structure is reviewed periodically, and any changes will be communicated with appropriate notice. All prices quoted include VAT where applicable.  

4.2 Payment Methods and Schedule  
We accept payment for credits and bundles via credit/debit card as well as payment for full class terms.  All classes must be paid for in advance of attending any classes and you will only be able to book into a class if you have a credit. Class bundles have different expiry dates depending on the size of the bundle. Once your credits have expired you will not be able to use those credits for any other classes and will need to purchase a new class credit or bundle.  If you have a good reason as to why you couldn’t use your credits, you may write to hello@nottinghillclub.co.uk and request an extension.  These will be considered on a case-by-case basis.

4.3 Children’s Term Classes
For children’s term time classes, you must sign up and pay for the full term in advance of the term beginning, or if you are joining half way through a term, pay for the rest of the term pro-rata depending on the number of classes remaining. There are no refunds or credits for unattended classes, and you will be charged for the full term regardless of how many classes your child attends.

4.4 Transferring Credits
If you have bought a single class credit, or bundle of classes you have the right to transfer credits to other customers of the Notting Hill Club.  You may also transfer a credit or use a credit for someone who is not a current customer, i.e. bring a guest, however, before they can attend a class they must register and accept the health waiver and release. 

4.5 Monthly Plans
If you sign up for a monthly plan, the amount will be charged to your preferred payment method on the day your plan begins and you will be able to book a class immediately.  The Plan begins on the date of initial purchase and automatically renews each month until canceled. Each Plan includes a fixed number of class credits that can be used during the corresponding monthly period. Unused classes do not roll over to the following month unless explicitly stated otherwise. The Plan fee is charged on a monthly basis at the rate specified at the time of purchase or as subsequently modified with prior notice. You can cancel a plan with one month notice, in the Plans section of your Account, or in writing to hello@nottinghillclub.co.uk.  You can also pause your membership with us, for up to two months per year without charge, this can be done in your account. 

5. CONSUMER RIGHTS

Cooling-Off Period
As a UK consumer you have the right of a cooling off period, meaning you may request a full refund within 14 days of making the purchase.  If you have attended any classes within that 14-day period, you will still be charged for this class and any refund made will be prorate. After the 14-day cooling off period, your cancellation will be subject to our standard cancellation policies.  No refunds can be offered for unused credits or bundles after the 14 day cooling off period.

6. HEALTH, SAFETY, AND CONDUCT  

6.1 Health and Safety Obligations  
Customers have a fundamental obligation to disclose any health conditions that may affect their ability to safely participate in Club classes. The Club reserves the right to request a medical clearance letter from a qualified healthcare professional where deemed necessary. Before attending a class, you must read the health release waiver, and we must be in receipt of a signed health release waiver on behalf of every child participating in a class, before they attend their first class.

Customers must not participate in any classes while under the influence of alcohol, drugs, or any substance that may impair their judgment or physical capabilities. The Club maintains the right to refuse entry or participation to any customer suspected of being under such influence.  

6.2 Code of Conduct  
The Club maintains a professional and respectful environment for all customers and staff. Customers and children are expected to conduct themselves in a manner that does not disrupt or interfere with other customers' enjoyment of the facilities. This includes, but is not limited to:  

- Maintaining appropriate personal hygiene and wearing suitable athletic attire  
- Treating all staff and fellow customers with respect  
- Refraining from using offensive language or behaviour  
- Following all posted rules and staff instructions  
- Respecting the privacy of other customers

7. LIABILITY AND INSURANCE  

The Club maintains comprehensive public liability insurance for the protection of our customers. However, this insurance does not extend to personal injury or loss resulting from customers' failure to follow Club rules or staff instructions, or from pre-existing medical conditions not disclosed to theClub.  

Limitation of Liability:

7.1 Responsibility for Loss or Damage:
We are responsible for any loss or damage you suffer as a direct result of our breach of these Terms or our negligence. Losses are considered foreseeable if they are an obvious consequence of our actions or were contemplated by both of us when the contract was formed. 

7.2 Personal Use Only
All classes are provided for personal use only. We do not guarantee that any goods or services (e.g., clothing) provided are fit for commercial purposes, including resale. We are not liable for loss of profit, business interruption, or missed business opportunities. 

7.3 Teacher Qualifications
Our teachers are fully qualified to instruct the classes they offer. However, their advice should not replace medical or professional health advice. Always seek appropriate advice from a qualified professional if needed. All teachers are bona fide self employed. A teacher's class is covered by their own public liability insurance. 

7.4 Personal Belongings
We do not accept responsibility for any personal items you bring onto our premises. We provide storage lockers on the first floor, these are used at your own risk and we cannot be held liable for loss or damage to personal belongings unless it is due to our own negligence or deliberate actions. Please do not bring valuables to our premises. 

7.5 Exclusion of Liability for Death or InjuryNothing in these Terms and Conditions excludes orlimits our liability for death or personal injury caused by our negligence or fraudulent actions. 

7.6 Consumer ProtectionIf you are a "consumer" under theConsumer Rights Act 2015 or other consumer protection laws, nothing in these Terms excludes or limitsyour legal rights. For more information on your rights, please refer to your local Citizens'Advice Bureau or Trading Standards.

8. PRIVACY AND DATA PROTECTION  

The Club processes personal data in accordance with the General Data ProtectionRegulation (GDPR) and applicable UK data protection laws. Our detailed PrivacyPolicy, available separately, outlines how we collect, use, store, and protectyour personal information.  

9. GENERAL TERMS OF USE AND TERMINATION

9.1 Class Changes or Teacher Substitution
The club reserves the right, giving as much notice as possible to customers to;
- Change or cancel a class and offer a different time to the customer
- Change an instructor, either due to a lack of availability, holiday or sickness

9.2 Termination by the Club  
The Club reserves the right to terminate or suspend a customer with immediate effect if:
- A customer breaches these Terms and Conditions  
- A customer engages in conduct deemed inappropriate or harmful  
- False or misleading information was provided during registration
- A customer acts in a way during a class that is unsafe, or poses a danger to themselves, another customer or a member of staff. 

10. FORCE MAJEURE

Neither party shall be liable for any failure or delay in performing their obligations under this agreement where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action, epidemics, pandemics, or other natural disasters. In the event of a Force Majeure:

10.1 The affected party shall promptly notify the other party of the nature and extent of the Force Majeure circumstances. 
10.2 The Notting Hill Club reserves the right to:
a) Temporarily suspend services and freeze any active credits or memberships for the duration of the Force Majeure event
b) Modify class delivery methods (e.g., transition to online classes where feasible)
c) Adjust facility operations to comply with any governmental regulations or health and safety requirements

10.3 Where services are suspended due to Force Majeure:
a) Member credits will be preserved, and their validity extended by a period equal to the duration of the suspension
b) Monthly membership terms will be extended accordingly
c) Any prepaid services will be honoured once normal operations resume

10.4 The duration of this agreement shall be extended by a period equal to the period of suspension caused by the Force Majeure event.

10.5 If the Force Majeure event continues fora consecutive period of more than 90 days, either party may terminate this agreement by written notice to the other party."

 11. AMENDMENTS TO THESE TERMS AND CONDITIONS

The Club reserves the right to amend these Terms and Conditions at any time. Customers will be notified of any material changes, and continued use of Club facilities after such notification constitutes acceptance of the modified terms.   

12. COMPLAINTS PROCEDURE

13. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
